The Law Numbered: 6698 on the Protection of Personal Data took effect on 24 March 2016. But why was a legal regulation needed for the protection on personal data?
Today, information and all kinds of data is in a state of circulation difficult to control while being backed by the almighty internet. With the advancement of information technologies, this circulation made innumerable data that belong to individuals further vulnerable to disclosure and access by unauthorized parties. It is without doubt that this possibility, which means a breach of personal rights, rendered the protection of personal data mandatory.
The protection of personal data is one the major topics that occupies the agenda for long time and approached sensitively especially by the countries of the European Union. This approach promoted steps in our country for making the necessary regulations for the protection of personal data. The Convention for the Protection of Individuals with Regard to Automatic Processing of Personal Data Numbered: 108, which, with the belief that "personal data need much protection than in the past", was issued by the European Council for the purpose of protecting personal with the same standards in all countries and determining the principles of cross-border data flow, was opened for signature on 28 January 1981, Turkey was amongst the signing parties and thereafter, the European Union initiated the implementation of the Directive on the Protection of Personal Data in 1995 (Directive 95/46/EC). Consequently, the protection of personal data became the agenda in Turkey after the 2000s and in 2016, a legislation that is parallel to the European Union Directive dated: 1995 was issued & effectuated with the aim of meeting the necessity for a regulation on the protection of personal data. But one should nevertheless state that the creation of individual and corporate awareness on the protection & storage of data mainly gained acceleration upon European Union's GDPR (General Data Protection Regulation) dated: 25 May 2018.
